The Insurance attorney is responsible for to manage the entire process with regards to the preparation of information for recovery purposes and preparation of court documents ( moto law, law of delict). Must also ensure compliance with internal department’s standards of delivery, copying and collating of documents as well as specific attention to compliance with court requirements and the cost effective management of all matters being produced in order to decrease time to cash with minimum delays.
Job Functions Legal

•Negotiate or persuade insured / uninsured individuals to settle claims timeously through daily calls on matter where legal process has or is to be implemented – making
and receiving calls
•Select matter for legal action based on internal criteria
•Monitoring daily tasks and campaigns of admin team
•Collation of all information provided by legal and pre-lit team
•Monitoring and updating of all required field on various systems
•Investigating all merit and quantums docs for verification of summons info
•Monitoring daily resolution of queries and monitoring frozen matters and closures(including query inboxes)
•Daily response to incoming correspondence
•Comprehensive interpretation of merits and assessment quantum
•Build string relationships with all stakeholders eg: third party’s and clients
•Regular reporting to Insurance manager and Executives
•Ensure that Financial targets are achieved – daily, weekly, monthly
•Monitoring regular follow up on all processes drafted, served, not served, application for default judgment
•Any other administrative tasks required by management
•Provide feedback to clients and brokers
•Managing bulk processing of summonses to be printed and updated on the systems
•Ensuring team-wrok between pre-lit and litigation team
•Take accountability and ownership of the entire legal process

Management of Cash Collections / Legal Process
•Compilation and preparation of
•affidavits and judgments
•system correspondence
•any other correspondence
•Ensure that the work process complies with legislative and court requirements.
•Ensure that the work process complies with quality requirements
•Check own work done on a daily basis before it is handed over for printing.

Book / File Management
•Update notes (flags) relating to the relevant status of accounts in accordance with legal flow requirements
•Coordinate and distribute legal documents to the appropriate department within the portfolio.
•Update and manage the Legal filing system.
•Update new contact information or addresses on Cheetah.

Relationship Management
•Give input on Legal operational issues to Team Leaders and executives


Knowledge and understanding of the following legislation:
National Credit Act
Debt Collectors Act
Prescription Act
Magistrates Court Act

Knowledge and understanding of the MBD inc. systems:

Required minimum Education/ Training:
Grade 12
Law Degree
Admitted Attorney
Knowledge of Insured claims re merits and case law
Right of appearance

Required minimum Work Experience:
1 - 2 years experience in a Collections Environment
Knowledge of Legal Collections Process (preferable)
Strong administrative background

•Understanding of the recovery handling process
•Computer literacy ( Excel, MS word)
•Understanding of the claims handling process
•Excellent negotiation skills
