To oversee and manage the day to day operations of Legal and ICAO Compliance Departments by ensuring compliance with all relevant legislation applicable to SACAA i.e. governance and aviation legislation ; ensure compliance to ICAO eight critical elements and Standards and Recommended Practices, Manage enforcement; Regulation development and provide adequate legal support services to SACAA, oversee and manage the ICAO Universal Safety Oversight Audit Programme Continuous Monitoring Approach and assist the Executive: Legal and Aviation Compliance with overseeing the functions of the National Continuous Monitoring Coordinator and monitor and e ensure that the ICAO on-line framework is adequately updated with the audited responses.
Lead and manage the operations of the Legal Department which shall include but not limited to the overall legal support services to SACAA, drafting and approval of legal opinions, contracts, exemptions, regulations and technical standards. Ensure compliance with national and international legislation impacting SACAA. Manage the enforcement, regulation development, general legal and ICAO Compliance sections. Ensure accurate revenue collection in terms of enforcement penalties. Advise the SACAA on legal compliance, which includes the creation of legislative & regulatory awareness and compilation of relevant compliance reports. Provide adequate legal support services to SACAA in order to minimize any legal risks that may arise.
Lead and manage the operations of the ICAO Compliance Department by ensuring that South Africa complies with the implementation of ICAO eight critical elements for both safety and security. Monitor compliance with the adopted standards and recommended practices. Oversee and manage the ICAO Universal Safety Oversight Audit Programme Continuous Monitoring Approach (ICAO USOAP CMA), assist the Executive: Legal and Aviation Compliance with overseeing the functions of the National Continuous Monitoring Coordinator. Ensure that the ICAO on-line framework is adequately updated with the audited responses.
Oversee and manage operational risks within the Departments.
Manage compliance with aviation legislation, ensure good corporate governance, ensure compliance with Public Finance Management Act, Treasury Regulations / Aviation and other applicable SACAA policies and legislation
Compile the Legal & ICAO compliance departmental budgets annually for approval by the Executive: Legal and Aviation Compliance in line with the PFMA and other appropriate legislation, policies & procedures.
Manage the overall budget and expenditure in line with approved parameters, and report variances as required in line with the PFMA and other appropriate legislation, policies & procedures
Management of Subordinates
Ensure the appointment and retention of staff; manage key performance areas of staff to achieve the agreed deliverables.
Oversee the mentoring and coaching of staff on an ongoing basis.
Provide strategic support to the Executive: Legal and Aviation
Compliance in managing the Annual Performance Plan deliverables for Legal and Aviation Compliance Division. Drafting submissions to the EXCO, the Board and its committees; providing any legal and technical support to the Department of Transport.
Strategy and policy development
Develop a legal and ICAO compliance strategy and action plans in line with the organizational strategy.
Manage & oversee the development, review and implementation of policies, strategies and procedures applicable to Legal, Enforcement, Regulation Development and ICAO Compliance departments.
An appropriate Bachelor’s degree in law / B.Proc / LLB
Must be an admitted Attorney or Advocate in the High Court of South Africa with Pupillage
Ideal Qualification: Master’s Degree in Law or MBA.
Certificate in auditing, compliance and aviation technical training will be an added advantage..
