This is a senior role, responsible for regulatory compliance at Herotel. The role will initially focus on leading the legal and regulatory compliance team with a focus on the wayleave application process, with a view to implementing and leading a full legal and compliance function.
This is not a researcher/advisor role, it is a hands-on role with the ability to interpret and apply legislation, regulation and solve complex legal and compliance challenges.
Key Responsibility Areas:
•Leading the legal and regulatory compliance functions and processes.
•Leading and managing the wayleave application process, document streamlining, standardization and practices, to ensure successful outcomes.
•Overseeing and managing legal disputes, negotiations, and litigation relating to wayleaves and other legal/regulatory matters.
•Managing relationships with regulators, bodies, and external suppliers.
•Implementing and maintaining regulatory compliance risk management framework.
Detailed Job Description:
•Leading and coaching a team of legal and regulatory compliance professionals in all areas, including the following key functions:
oWayleave process and related matters.
oICASA regulatory compliance and reporting including licensing management.
oCommercial agreement drafting and negotiations.
•In relation to wayleave applications:
oEngage with Planners, Regional Managers, and legal team (internal and external) regarding progress, process and challenges related thereto. Lead and advise on practical solutions for successful outcomes.
oImplement standardized, streamlines and best practices.
oReview and ensure completeness and accuracy of applications.
•Overseeing and leading disputes and litigation, in conjunction with internal and external legal team.
•Managing compliance, including the compliance framework and programme, and regulatory reporting.
•Interpreting legislation and advise on compliance risks, and compliance controls.
The successful candidate must have the following experience/skills: -
•8 -10 years senior experience in legal and regulatory practice as an admitted attorney (preferable).
•Working knowledge of telecommunications legislation and regulations (including but not limited to ECA, RICA, POPI, ICASA, and licensing regulations, and PAJA) is a minimum requirement.
•Experience working with regulators, municipalities, and regulatory compliance is essential.
•Compliance risk management, frameworks, and standards.
•Ability to interpret and apply legislation and regulations.
•Proven ability to lead a team of professionals.
•Must be Self-driven

•Strong negotiation skills
•Assertive in nature
•LLB Degree or similar.
•Certified Compliance Practitioner (CISA) preferable or similar qualification/designation.
•Additional qualification relating to Town Planning would be advantageous.
